Terms and Conditions

These draft Terms explain how Builders App may operate as a construction technology platform for builders, homeowners, suppliers and administrators.

Working draft: this page is provided for planning and website drafting only. It must be reviewed and approved by a qualified UK solicitor before publication or use with customers.

Platform operator and company information

Builders App is the trading platform shown on this website. Final company name, registration number, registered office, VAT details and customer contact information must be inserted before publication.

Eligibility and account registration

Users must provide accurate information when creating an account. We may refuse, suspend or close accounts where information is incomplete, misleading, unlawful or inconsistent with platform requirements.

Builder, homeowner, supplier and admin accounts

Different account types may have different permissions, fees, verification requirements and responsibilities. Administrators may manage platform operations, support requests, moderation, verification and account controls.

Identity and business verification

Builders and suppliers may be asked to provide identity, business, insurance, qualification, trade, address and payment information. Submitting information does not guarantee approval.

Builder qualifications and responsibility

Builders remain responsible for their qualifications, competence, licences, insurance, site safety, regulatory compliance, quotations, work quality and customer contracts.

Subscription plans and free trial

Eligible new builder accounts may receive a one-month free trial. Trial eligibility, trial duration, billing date, renewal price and cancellation method must be shown before the user commits.

Automatic renewal and cancellation

Paid subscriptions may renew automatically unless cancelled in accordance with the cancellation process shown at checkout and in the Subscription and Cancellation Policy.

Refund policy

Refund eligibility depends on the plan, user type, statutory rights, service usage and timing of cancellation. The Refund Policy explains the draft approach.

Included room scans and additional scan tokens

Builder plans may include a set number of room scans per billing period. Additional scan tokens may be purchased. Tokens may expire, may be non-transferable and may not be redeemable for cash unless required by law.

Homeowner project fees

A homeowner project fee may cover one structured project workspace only. It does not include building work, labour, materials, contractor costs or unlimited projects unless expressly stated.

Job opportunities and lead generation

Builders App may show relevant opportunities to eligible builders. We do not guarantee jobs, leads, acceptance, revenue, customer demand, builder availability or project outcomes.

Relationship between builders and homeowners

Unless expressly stated, Builders App is not a party to building contracts between builders and homeowners. Builders act as independent contractors and are responsible for their work and agreements.

Supplier listings and prices

Supplier listings, prices, availability and delivery information may be provided by suppliers or third parties and may change. Users must check current pricing and availability before ordering.

Third-party services and external links

The platform may link to app stores, payment providers, video platforms, suppliers and other third-party services. Those services have their own terms and policies.

Payments, commissions and service fees

Any subscription, lead fee, commission, transaction charge or service fee must be shown clearly before the user commits to payment or job acceptance.

User-generated content

Users are responsible for messages, photographs, scans, measurements, documents, project notes and other uploaded content. Users must have the rights and permissions needed to upload and share that content.

Accuracy limitations

Room scans, AI measurements, material estimates, reports and suggestions may be approximate and must be checked by competent users before reliance, ordering, quoting or building work.

Prohibited use

Users must not misuse the platform, upload unlawful content, infringe rights, harass others, submit false information, bypass security, scrape data or use the service for unsafe or illegal activity.

Account suspension and termination

We may suspend or terminate accounts where required for security, non-payment, suspected fraud, verification failure, misuse, legal compliance or breach of these Terms.

Intellectual property

Builders App owns or licenses the platform, software, branding, designs and content. Users receive only the limited rights needed to use the service in accordance with these Terms.

Privacy and data protection

Personal data is handled in accordance with the Privacy Policy. Users must not upload personal data they are not entitled to share.

Communication and notification consent

Users may receive service messages, project notifications, account alerts, billing notices and administrative communications through the app, email, SMS or other provided channels.

Service availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. Maintenance, updates, outages and third-party failures may affect access.

Limitation of liability

Liability must be reviewed by a solicitor. Draft terms should not exclude liability where it would be unlawful, including for death or personal injury caused by negligence or fraud.

Indemnity

Business users may be required to compensate Builders App for losses caused by their breach, unlawful use, false information, content misuse or third-party claims.

Complaints and dispute resolution

Users should contact support first. The final policy should explain complaint handling, escalation routes and any available dispute resolution process.

Changes to pricing, features and Terms

Pricing, scan limits, features, add-ons and these Terms may change. Users should receive appropriate notice where required by law or contract.

Governing law

These draft Terms are intended to be governed by the laws of England and Wales, subject to mandatory consumer rights that may apply.
